For serious traffic offenses (DUI, Ignition Interlock Violations) and other offenses not related to traffic the defendant is arrested and taken to jail. Other certain offenses may be issued a Non-Traffic Citation or a Summons and Complaint.
On View/Warrantless Arrests: The arrestee is transported and booked into the Morgan County Jail under the custody of The City of Hartselle. The defendant will be able to post a bond for release or will be released with an own recognizance appearance bond. Defendants unable to post a bond or not given an own recognizance bond for release shall be seen through a video hearing by the Judge within 48 hours.
Warrant Arrests: The arrestee is transported and booked into the Morgan County Jail under the custody of the City of Hartselle. The warrant will indicate if the defendant may post a bond or be released with an own recognizance appearance bond. If the defendant is unable to post a bond or if the warrant is for a probation violation or revoking a previous bond, the defendant shall be seen through a video hearing by the Judge within 72 hours.
Non-Traffic Citations: Certain offenses may be charged on a Uniform Non-Traffic Citation and Complaint. The defendant is issued the citation and released on their own recognizance without arrest to appear in Court on the date and time shown on the citation. Contact the Court Office to inquire if your citation requires a court appearance or may be settled prior to court.
Non-Custodial Arrests: Certain offenses may be issued a Summons and Complaint as a non-custodial arrest. The defendant is under arrest but is not taken to jail for booking. The defendant shall be required to report to the Court Clerk's Office within 10 days from the date of the offense to enter a plea of guilty or not guilty. If a guilty plea is entered, the defendant must sign a Plea of Guilty/Waiver of Rights form. If a not guilty plea is entered, the defendant will be given an own recognizance appearance bond with a court date and time.
